The strata titles

I called up the developer to find out the status of the application for strata titles. I was really annoyed and disappointed when I was told that the application for strata titles have not been submitted to the land office. In the meeting we had with the management last year, we were told that the application would definitely be submitted to the land office by last year. I was told that they are still in the process of applying.
I happened to have a meeting with the YB Yew Teong Look, the member of parliment for Wangsa Maju. He is also the parlimentary secretary for Wilayah Persekutuan. He is a really a friendly and helpful guy who is without any air. I posed a couple of questions to him. He told me to file a complaint with the housing ministry. According to the housing act 2002, there is a stiff fine and a daily penalty if the developer fails to apply for the strata titles 6 months after the C.F. is issued . But how many developers bother to do so when the ruling is hardly enforced. It's the Malaysian system that is at fault.
I don't really wish to strain the relationship between the R.A. and the management by making a hasty complaint at the moment. I shall deligently pursue the matter at the meeting with Dats Management Sdn Bhd soon. We shall know what is holding up the application. They may have a genuine reason to do so.
To the R.A, the strata titles is our priority as without the titles, we can't really call our properties our own.

well, i guess since the developer would like to control the funds for as long as possible, hence they won't bother to submit it ... unless we keep on barking at them ... even with constant barking, i'm sure they've 1001 excuses to delay it ...

well, we have to admit the whole govn's rules, regulations, enforcements pertaining to housing are in TOTAL MESS ... else you won't have different story about irresponsible developer highlighted in TV on daily basis recently ... if Ong Ka Ting can't do anything to correct the mess (his hand is tied as well, dude), don't think Yew Teong Look can do anything ...

worst case, i guess we need to write in to TV3 to get "attention" ... that's how the system works here dude ...

anyway, appreciate what our president has done so far ...

Hi,
I am one of the proprietor. The procedure is the developer have to apply for strata title, 6 months after the issuance of C.F. to the proprietor/owner. It's in the Strata Title Act 1985, Section 8. Owners, please read this book, then you will know your rights. Then, the developer will engage a licensed land surveyor (LS) to survey the land and the parcels to produce strata title plans. LS is the major player in strata title process, he will prepare the plans to be submitted to land & mines office (PTG), not land office. PTG will approve on the share units, parcel numbering and etc. Once approved by PTG, LS will submit to survey department (SD) for approval on the strata certified plan. Once approved, SD will prepare the strata title and give it to PTG for approval. Only then, we all can have our strata title. But, as i have said, LS is the major player because LS is the one who know very well about the procedures and he's the runner for the survey and approval by the authorities. Developer also have to responsible because as a client to the LS, they have to push for it, unless they purposely delay the process by asking the LS not to submit anything to the authorities. I am a land surveyor & i know the procedures. I know their hanky panky. There are a few question i need to check further, if anybody knows. Who's the LS? What's the land certified plan number for prima setapak plan? Any goverment reference number either from PTG or SD? To expidite this process, owners must write letters, lots of letters to PTG, SD, housing ministry & cc to prime minister department, cc to developer, cc to LS, cc to the press & etc. We must let them know this issue and we are serious about it.

It's nice to know that we have a L.S staying at our condo. You must be well versed in matters pertaining to strata titles. Perhaps, you can give me your contact number so that the R.A. can consult you about matters pertaining to strata titles.

Fred, if Ong ka Ting cannot do anything, doesn,t mean that YB Yew cannot do anthing. Anyway, it's impossible to have an appointment with him . I am the R.A.'s secretary for Genting Court. We have meeting with him quite often. Due to the numerous problems we are facing in Genting Court, he is assisting us to deal with the liquidator. Although our property is a private property, he has instructed DBKL to upgrade the infrastructure at Genting Court. At Prima, he has indicated that he can be mediator if there are problems arises bet the R.A. and the developer. There is no harm seeking his assitance. After all, it's free.

it's nice to know that YB Yew can perform better than his own boss (president) ... ;-)

what i meant was he can't move the whole machinery as there are simply to much red-tape (which is not under his jurisdiction) to get things done from point-A to point-B ... this is the work-culture within govn (everybody knows this) ...

hence we have 2 main obstacles ... (1) within the developer itself ... (2) within the govn itself ...

i'm not sure how true it is, but from the source i heard (correct me if i'm wrong) genting court still does not have CF till today ... hope nothing bad will happen and the building is as strong as it is ...

You cannot insinuate that YB can perform better than his own boss. It's just that we would not be able have an appointment with him. As a minister he would be too busy to attend to us. YB is our member of parliment for Wangsa Maju. He deals with the grassroot.We are not fighting the system or trying to change any policies here. we have to do it step by step. There are properties developed by UOA which have got Strata Titles. One of which is La Villa at Jalan Gombak. We just need to have patient.
For your info, Genting Court has got C.F. long ago. YB is acting as a co-ordinator bet us and the liquidator to apply for strata titles.
I strongly believe that eventually, we would have our strata titles. You can't fight the system, you have to adapt to the system. That's how we got the C.F. for Genting Court.

i'm not trying to fight the system (i'm not qualify to do it anyway) ... i learnt "that" when i was even a student ... got what i mean ?

and you can be sure that adapt i have, all these while ... else i would have heart-attack & high-blood pressure ages ago ...

yeah, i bet he "deals" with grassroots else he won't get voted in, would he ?
